NYSRPA/SAF lawsuit update
Update to the NYSRPA/SAF lawsuit against NYC over the gun license fees: Oral arguments were made yesterday in the 2nd Circuit Court appeal. The judges asked repeatedly the attorneys for the City and State to justify the cost difference inside and outside of NYC and did not appear to be satisfied with the answers given. They were also very interested in legislative history materials.
Our lawyers opinion is “guarded optimism.” A decision could come at any time, but probably not before summer.

Shockingly, the Governor’s popularity is declining despite his assertion that his gun law really isn’t that bad:
“Gov. Andrew Cuomo’s job approval rating dropped 15 percentage points because of voters’ concerns about the new gun-control law, a poll released Wednesday found. Cuomo’s approval rating — which has been virtually unblemished since he took office in 2011 — fell from 74 percent to 59 percent, according to the Quinnipiac University poll …”
Lawsuit press
The media is giving us lots of press for suing over the Cuomo gun law. Had they given our side a fraction of the attention we’re getting now right after the State of the State, I don’t think the bill would have passed.

Gawker discovers that gun control isn’t the only thing on Mayor Bloomberg’s mind:
“… My friend and I followed the host over, shook Bloomberg’s hand, and my friend thanked him for his position on gun control. Without even acknowledging the comment, Bloomberg gestured toward a woman in a very tight floor-length gown standing nearby and said, “Look at the ass on her.” …”

Pols surprised by reaction
I’m getting the impression that many state legislators, and even Gov. Cuomo, are surprised by the public reaction to the SAFE Act. Worse (for them) the notion that the overwhelming majority of gun owners will simply ignore the law is starting to seep into the media’s consciousness.
“… Gun-range owners and gun-rights advocates are encouraging hundreds of thousands of owners to defy the law, saying it’d be the largest act of civil disobedience in state history … State officials will be nervously watching the registration figures to see how many gun owners comply, sources said. “I believe you will have people stepping forward, saying, ‘Here I am. See? I have what you call an assault rifle. Now come and take it away,’ ’’ said a gun-rights activist and boycott organizer. That’s exactly what state officials are worried about …”
“… I don’t suppose it’s dawned on any of our legislative leaders, at least not yet, that what transpired over gun control in political Albany might actually increase the risk of gun violence rather than diminish it. After the law was signed, I was surprised how adamant and angry a raft of callers were, even members of law enforcement … I am fearful there will be widespread non-compliance and certainly deep resentment, which in turn creates outlaws out of the law-abiding …”
Of course, nobody’s going to come out and admit they made a mistake. Certainly not Cuomo, even if the issue starts hurting his purported presidential ambitions.
