Cuomo resigns

Lawsuit against gun manufacturers coming soon

Since the legislature passed the liability bill A-6762A/S-1048A it is only a matter of time before Tish James files a lawsuit based on it against one or more gun manufacturers and/or dealers.

She’s getting encouragement from the White House:

“Today, Domestic Policy Advisor Susan Rice, White House Counsel Dana Remus, and Director of the Office of Intergovernmental Affairs Julie Rodriguez hosted a virtual convening with attorneys general from seven states and the District of Columbia to discuss policies and strategies for holding gun manufacturers and dealers accountable for wrongful conduct that contributes to the supply of firearms used to commit gun crimes … As directed in the President’s gun crime reduction strategy, participants in the convening also discussed how we can hold gun manufacturers and dealers accountable for unlawful conduct while PLCAA is still the law of the land. Attorneys general discussed the opportunity and barriers to using generally applicable state consumer protection and nuisance laws to take action against gun manufacturers and gun dealers under PLCAA’s predicate exception. They also discussed how state legislators could enact firearm-specific liability laws, like New York State’s new law, to potentially create new predicates allowing litigation to proceed under PLCAA …”

We’re going to see a junk lawsuit from New York State real soon.

Michael Henry for Attorney General

A NYC lawyer I’ve never heard of, Michael Henry, has declared his intention to run as a Republican next year for Attorney General:

“… Michael Henry, a commercial litigation attorney, announced Monday he’s hoping to unseat the incumbent Democrat, who he accused of being soft on crime … Henry also accused James of going easy on Gov. Cuomo and his administration’s handling of the COVID crisis …”

This tells me nothing.

I don’t see a campaign website for him, but he did form an election committee with the BoE.

Possible scenario

For the sake of argument, lets assume Gov. Cuomo is forced out due to his bad behavior. Kathy Hocul would then become acting Governor until the 2022 elections.

I can’t see the Democrats letting her keep that office as she isn’t from the NYC area. The most likely candidate would be Tish James. In many ways James is worse than Cuomo in so far as she is an political ideologue whereas Cuomo is a political opportunist.

Senator Alessandra Biaggi’s name has been floated as a candidate for higher office, possibly for Lieutenant Governor. Another ideologue, a James-Biaggi ticket would be bad for just about everything including 2A rights.

As awful as Cuomo’s behavior has been and as destructive as “progressive” policies have been for the state, I don’t see Republicans being in a position to capitalize on any of it in New York. On the national level I think the GOP has plenty of opportunities for advancement especially if they stand firm against any gun control.

NRA Directors take note

The NRA Board should take a long, hard look at what Tish James just did to Gov. Cuomo. If they don’t clean up their act they are next.

Henry v. County of Nassau

The 2nd Circuit Court revived and remanded a lawsuit challenging Nassau County’s revocation of a pistol license, saying that “the district court failed to treat the right to keep and bear arms as an individual right.”

The case is Henry v. County of Nassau. Here is the order (PDF).
