SAFE challenge halted for now

Due to Justice Antonin Scalia’s untimely demise, NYSRPA’s lawsuit challenging the SAFE Act has been halted.

I figured this was going to happen, but it still stings nonetheless.

I have to stress that this is only a temporary setback.  Other good gun cases are still active around the country that may prove helpful over the long term to our cause in New York.  That is the way to play the game, by thinking long term.  Where will we be in 5, 10, 20+ years down the line?

In the meantime, everyone should continue to fight the good fight.

  1. Will NYSPRA try for cert IF the election outcome proves favorable and a SCOTUS judge is locked in that will be good? If not. We have a very very very long wait.

  2. I don’t know what is coming next. CCDL is trying for cert with their case which may be better due to differences in the way the CT law is written. Plus there is the Maryland case which also might be better due to the strict scrutiny ruling.

  3. I support the decision beucase I myself became very nervous upon the death of Scalia. I never trusted Roberts or Kennedy. Both of them have seem to be going against the ideology they were suppose to represent. This just tells you that the judges can turn anytime on those they once supported. NYSPRA did the right thing, it’s unfortunate with all the money spent and time, that the effort will be vain. However, as you said Jacob. Karma is a bitch and Andy might still get his, if your premonition holds true still. If Preet can rid us of him, the chances are better for Gibson or Astrino. I am hoping for that as Plan C. Maybe that is the only hope as well.

Justice Scalia was the single most important last remnant of not just 2A, but the Constitution, the rule of law, and the original Republic, and stood as a giant defender between us and this new dark age (to borrow from Mr. Churchill). Look at where we are. Obama is POTUS, and it will be Hillary vs. Trump in 2016. These people, in and of themselves, are not the issue. The idiot, the crook, the unsavory, et al, have always walked the earth. The terrifying part is that their running for office is a reflection of the state of the nation. Abysmal! In 2008, when Obama was elected, I knew it was all over just by that possibility having materialized. I just read an article in a local paper that I sometimes write for, that Obama appointed 900 federal judges. The damage is immense. That is why we are seeing what we are seeing. I was watching a thing on the Third Reich last night and fascinating that Hitler used phrases like “make Germany great again” and “transformation”. Nothing new under the sun.

    Where are we now? That’s the immediate issue!
    I was red pilled on Monday morning before work. Never saw it put like this before. Couldn’t make sense of it at first, and had to look up the Wikipedia article on “Cargo Cult” and then think about it for a while. Do read it and think about it for yourself. Mull it over. Shocked me.   7. The legal framework for Heller started in the 70s. It took 30+ years of work to get that. That is the sort of timeframe we’re looking at in NY, NJ, etc.
