Win in the courts for part-time residents

State court says part-time residents can apply for pistol licenses:

“New York’s highest court says people who live only part-time in the state can get handgun licenses here.  The Court of Appeals says New York pistol permits, which are issued by cities or counties, are not limited to people whose primary residence is in New York …”

NRA backed this case.  I have not seen the decision yet so it is too soon to predict the ramifications of the case.

  1. The dilemma: if NYS limits handgun licenses to residents then they convert NY Law to replacement of 2A right. If NYS opens handgun licenses to non residents, NY then acknowledges impact upon interstate travel and 2A comes in through the window.

This Court will take the issue head on and dump law in light of SCOTUS rulings.

Look on SCOPE site for NYS police rules and regs for SAFE. They are “delegating” authority of enforcement to local LEO who expressly don’t want it. Cuomo & Co.are about as tuned in on this as WH is on Obamacare.

  2. From a lawyer friend:

You are seeing handwriting on wall. Horns of dilemma: if they limit it to residents then they convert ny law to replacement of 2A right. If they open it to non residents then they acknowledge impact upon interstate travel and 2A comes in through the window.

  3. this will include all of those people who have apartments in NYC. Bloomburg is going to have a hissy fit. We will have to see what happens to someone who has a house in NYC and a 2nd home outside of NYC.
