  1. I’m curious, if NYS has a RKBA in it’s State Constitution, who can something like this be constitutional?

    Some fellow NJ gunnies say that if NJ had such a thing, NJ wouldn’t be in the position it is now.

    I tell them to look at NYS, or Illinois, and see how well that’s working out for them.

  2. It’s not in the state constitution. It’s in NYS Civil Rights Law Article 2, Section 4: “A well regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms cannot be infringed.”

  3. It probably wouldn’t matter too much if NY/NJ had it in their constitutions. Statements have been made by legislators wrt to antigun legislation that, yes their bills are probably unconstitutional, but you’ll have to go to court to prove it.

    NY state law on issuing Pistol Permit:
    Section 400.00 of the NYS Penal Code, Paragraph 4-a

    4-a. Processing of license applications. Applications for licenses
    shall be accepted for processing by the licensing officer at the time of presentment. Except upon written notice to the applicant specifically stating the reasons for any delay, in each case the licensing officer shall act upon any application for a license pursuant to this section within six months of the date of presentment of such an application to the appropriate authority.
    Such delay may only be for good cause and with respect to the applicant. In acting upon an application, the licensing officer shall either deny the application for reasons specifically and concisely stated in writing or grant the application and issue the license applied for.

    The Pistol permit office’s web site declares –
    Applicants must come to our office in person when submitting the completed application. The processing time to receive a permit is approximately 6-8 months.

    The actual processing time is running 12 to 18 months.
    All are in direct violation of NYS Law.

    It’s a beautiful case for a class action law suit, but they have you over a barrel and your civil rights mean as much as the statutes. Nothing! We can do what ever we want because we are your LEADERS so unless you are in the State Employees Union Shut UP!
