It is the weirdest case they could have before them after the city ran scared and backed off. A strict scrutiny precedent is what we really need, but it will be a very pleasant BIG surprise if it happens here. Any thing better than moot will be a victory for us. I see Roberts punting on this. He does not want 2A cases in his court. A moot decision will mean nothing. The only thing we have really going for us is the threat that the communists made against the court. How really pissed are they?
