Media reports that Obama will pick Solicitor General Elena Kagan as his nomination for Supreme Court Justice. She’s from Manhattan which isn’t good. According to the Washington Post:
“… She is known to be circumspect with her personal views and has no public record on some of the hot-button social issues — such as abortion and gun control …”
Best we can hope for is to delay confirmation of any of his nominations until after the incorporation holding. Last I heard that decision is due in June.

Roberts was born in Buffalo. Ginsburg in Brooklyn. Sotomayor
in the Bronx. If confirmed, Kagan who was born in Manhattan would be the 4th New Yorker currently serving.
Silver lining: Unlikely that Obama would nominate Chuck should another opening occur because he would be #5.

The article to which you refer probably meant New Yorker in the stricter sense, ie: NYC.
