Watching Gorsuch conf, struck me that (paraphrase) “precedent has less weight if it is an island”. Well, the circuits have made Heller “an island” (other courts have repeatedly, if not unanimously, eviscerated it). Not just that, but SCOTUS itself rebuffed it in Highland Park. Coupled with his other statements, I am still concerned here.
I am impressed with the superior intelligence of all these people which this process is illustrating. However, I am hoping someone brings up “interest balancing” cause that is one of the infrastructures of judicial activism.
