{"id":8694,"date":"2013-06-24T17:41:41","date_gmt":"2013-06-24T21:41:41","guid":{"rendered":"http:\/\/www.gunpoliticsny.com\/?p=8694"},"modified":"2013-06-24T20:24:54","modified_gmt":"2013-06-25T00:24:54","slug":"state-response-to-safe-lawsuit","status":"publish","type":"post","link":"http:\/\/www.gunpoliticsny.com\/?p=8694","title":{"rendered":"Antis respond to SAFE lawsuit"},"content":{"rendered":"<p>First round of <a href=\"http:\/\/blog.timesunion.com\/capitol\/archives\/190040\/kathleen-rice-james-sheppard-line-up-for-safe-act\/\" target=\"_blank\">antigunners respond<\/a> to the SAFE lawsuit:<\/p>\n<blockquote><p><em>&#8220;<a href=\"http:\/\/www.nassauda.org\" target=\"_blank\">Nassau County District Attorney Kathleen Rice<\/a>, <a href=\"http:\/\/www.cityofrochester.gov\/police\/\" target=\"_blank\">Rochester Police Chief James Sheppard<\/a> and a top State Police lawyer all filed sworn statements as part of over 100 pages filed by <a href=\"http:\/\/www.oag.state.ny.us\" target=\"_blank\">Attorney General Eric Schneiderman<\/a> in reply to the suit, which was brought in March in a federal court in Buffalo. \u00a0\u201cNew York\u2019s bans on assault weapons and large- capacity magazines do not even implicate Plaintiffs\u2019 <a href=\"http:\/\/www.law.cornell.edu\/constitution\/second_amendment\" target=\"_blank\">Second Amendment<\/a> rights, because such weapons are not within the sco<\/em><em>pe of Second Amendment protection,\u201d the state argues in court papers. \u201cIn any event, even if they did substantially burden Plaintiffs\u2019 rights, these provisions so clearly satisfy New York\u2019s interests in public safety and crime prevention that they easily survive co<\/em><em>nstitutional scrutiny.\u201d &#8230;<\/em><\/p><\/blockquote>\n<p><a href=\"http:\/\/www.gunpoliticsny.com\/?p=8505\">As expected<\/a>.<\/p>\n<blockquote><p><em>&#8220;Rice and Kevin Bruen, the State Police lawyer, argue assault rifles are ill-suited for home defense because their rounds can easily pierce walls and injure family members. \u00a0Shotguns, Bruen rights, are preferable &#8230;&#8221;<\/em><\/p><\/blockquote>\n<p>Was not expecting them to cite <a href=\"http:\/\/www.huffingtonpost.com\/2013\/02\/19\/joe-biden-guns_n_2719330.html\" target=\"_blank\">noted firearms expert Joe Biden<\/a> though.<\/p>\n<p><a href=\"http:\/\/www.buffalonews.com\/apps\/pbcs.dll\/article?AID=\/20130624\/CITYANDREGION\/130629518\/1002\" target=\"_blank\">Second round of antis respond<\/a>:<\/p>\n<blockquote><p><em>&#8220;&#8230;\u00a0\u201cAssault weapons are enablers of violent crime and mass murder,\u201d the <a href=\"https:\/\/www.majorcitieschiefs.com\" target=\"_blank\">Major City Chiefs Association<\/a> said in a friend-of-the-court brief filed in U.S. District Court in Buffalo. \u00a0The association, which counts <a href=\"http:\/\/www.bpdny.org\" target=\"_blank\">Buffalo Police Commissioner Daniel Derenda<\/a> and 62 other urban police chiefs as members, views the new law as an important step in curbing the illegal use of assault weapons &#8230;&#8221;<\/em><\/p><\/blockquote>\n<p>They&#8217;re politically appointed and not directly accountable to the people, unlike members of the <a href=\"http:\/\/www.nysheriffs.org\" target=\"_blank\">NYS Sheriffs Association<\/a> which opposes SAFE.<\/p>\n<ul class=\"ssb_list_wrapper\"><li class=\"fb2\" style=\"width:135px\"><iframe src=\"\/\/www.facebook.com\/plugins\/like.php?href=http%3A%2F%2Fwww.gunpoliticsny.com%2F%3Fp%3D8694&amp;layout=button_count&amp;action=like&amp;show_faces=false&amp;share=true&amp;width=135&amp;height=21&amp;appId=307091639398582\" scrolling=\"no\" frameborder=\"0\" style=\"border:none;
