{"id":8428,"date":"2013-05-15T14:21:04","date_gmt":"2013-05-15T18:21:04","guid":{"rendered":"http:\/\/www.gunpoliticsny.com\/?p=8428"},"modified":"2013-05-15T14:21:04","modified_gmt":"2013-05-15T18:21:04","slug":"safe-lawsuit-update","status":"publish","type":"post","link":"http:\/\/www.gunpoliticsny.com\/?p=8428","title":{"rendered":"SAFE lawsuit update"},"content":{"rendered":"<p>Here is the latest update on <a href=\"http:\/\/www.nysrpa.org\" target=\"_blank\">NYSRPA&#8217;s<\/a> lawsuit against the SAFE Act:<\/p>\n<ul>\n<li>We have filed both a Complaint and an Amended Complaint in the <a href=\"http:\/\/www.nywd.uscourts.gov\" target=\"_blank\">USDC for the Western District of New York<\/a>. \u00a0Our Amended Complaint claims that the SAFE Act is unconstitutional in that it violates the <a href=\"http:\/\/www.law.cornell.edu\/constitution\/second_amendment\" target=\"_blank\">Second Amendment<\/a>, the <a href=\"http:\/\/www.law.cornell.edu\/wex\/equal_protection\" target=\"_blank\">Equal Protection Clause<\/a>, and is unconstitutionally vague.<\/li>\n<li>Subsequent to the filing of our Amended Complaint, we filed a Motion for Preliminary Injunction asking the Court to Order all defendants to cease the enforcement and prosecution of the SAFE Act. \u00a0The Court has not yet decided our request.<\/li>\n<li>After a hearing to establish a briefing schedule, <a href=\"http:\/\/www.nywd.uscourts.gov\/hon-william-m-skretny\" target=\"_blank\">Judge William Skretny<\/a> issued a Scheduling Order. \u00a0Under the Order, the following deadlines were set: the time for all defendants to file an Answer to the Amended Complaint was stayed until June 7.<\/li>\n<li>All defendants have until June 7 to respond to our motion for preliminary injunction or cross-move for dispositive relief.<\/li>\n<li>The plaintiffs have until July 8 to oppose any cross-motion by the defense and\/or reply to any opposition to the motion for PI; and the defendants&#8217; time to reply to any opposition filed by the plaintiffs was not decided, but will be addressed by the Court at a later date.<\/li>\n<li>The Court set August 23 as the next date for the parties to return to court, characterizing this date as a <em>&#8220;status conference\/hearing date, with emphasis for now on status conference.&#8221;<\/em><\/li>\n<li>To date NYSRPA has spent $164,000 on the suit and have received an additional $80,000 from the <a href=\"http:\/\/www.nradefensefund.org\" target=\"_blank\">NRA Civil Rights Defense Fund<\/a>.<\/li>\n<\/ul>\n<ul class=\"ssb_list_wrapper\"><li class=\"fb2\" style=\"width:135px\"><iframe src=\"\/\/www.facebook.com\/plugins\/like.php?href=http%3A%2F%2Fwww.gunpoliticsny.com%2F%3Fp%3D8428&amp;layout=button_count&amp;action=like&amp;show_faces=false&amp;share=true&amp;width=135&amp;height=21&amp;appId=307091639398582\" scrolling=\"no\" frameborder=\"0\" style=\"border:none;
