Constitutional lawyers the Baltimore Sun<\/a> spoke with regarding the case against discretionary licensing think the ruling will be upheld. \u00a0In a nutshell:<\/p>\n

“… “The idea here is that if this is a constitutional right, like all the other constitutional rights, then you shouldn’t need the government’s permission to exercise it,”<\/strong> said Randy E. Barrett, a professor at Georgetown University Law Center<\/a> in Washington …”<\/em><\/p><\/blockquote>\n

Exactly.<\/p>\n

The antis’ aren’t giving up<\/a> though:<\/p>\n

“… \u00a0Jonathan Lowy, director of the Brady Center’s Legal Action Project<\/a>, said it’s “perfectly reasonable and prudent for Maryland to have law enforcement decide who has a demonstrated need to carry loaded guns in public.” \u00a0“There’s a whole other level of risk that the public is exposed to when civilians carry loaded guns on public parks, streets, in restaurants, what have you.” \u00a0Lowy called the decision a “very dangerous precedent” that is not supported by case law and said he expects it to be reversed …”<\/em><\/p><\/blockquote>\n

Really? \u00a0According to the first story the 4th Circuit Court of Appeals<\/a> said in a 2010 ruling that the 2nd Amendment<\/a> likely extends outside the home. \u00a0If that’s true, I don’t see them overturning the decision.<\/p>\n
