{"id":5138,"date":"2011-12-03T11:54:37","date_gmt":"2011-12-03T16:54:37","guid":{"rendered":"http:\/\/www.gunpoliticsny.com\/?p=5138"},"modified":"2011-12-03T11:54:37","modified_gmt":"2011-12-03T16:54:37","slug":"guns-and-the-courts","status":"publish","type":"post","link":"http:\/\/www.gunpoliticsny.com\/?p=5138","title":{"rendered":"Guns and the courts"},"content":{"rendered":"<p>The next President will likely get to nominate a couple of candidates to the <a href=\"http:\/\/www.supremecourt.gov\" target=\"_blank\">Supreme Court<\/a>. \u00a0<a href=\"http:\/\/www.whitehouse.gov\" target=\"_blank\">Obama&#8217;s<\/a> nominations were stinkers which is why he needs to be defeated in next year&#8217;s elections. \u00a0While I do not believe he has an antigun litmus test for nominations, <a href=\"http:\/\/newsandinsight.thomsonreuters.com\/New_York\/News\/2011\/12_-_December\/DC_Circuit_nominee_Halligan_headed_for_vote_showdown\/\" target=\"_blank\">this Reuters story<\/a> underscores the undesirable sort of judicial candidates he chooses:<\/p>\n<blockquote><p><em>&#8220;<a href=\"http:\/\/www.senate.gov\" target=\"_blank\">Senate<\/a> majority leader <a href=\"http:\/\/reid.senate.gov\" target=\"_blank\">Harry Reid<\/a> has scheduled a cloture vote next week on the nomination of <a href=\"http:\/\/www.law.columbia.edu\/fac\/Caitlin_Halligan\" target=\"_blank\">Caitlin Halligan<\/a> to the <a href=\"http:\/\/www.cadc.uscourts.gov\" target=\"_blank\">District of Columbia Circuit Court of Appeals<\/a>, setting up a likely showdown on the controversial nominee &#8230; Halligan, who is currently general counsel for the <a href=\"http:\/\/www.ag.ny.gov\" target=\"_blank\">New York District Attorney&#8217;s<\/a> office, was nominated by Obama in September 2010 &#8230; Halligan has been supported by liberal-leaning groups such as the <a href=\"http:\/\/www.nwlc.org\" target=\"_blank\">National Women&#8217;s Law Center<\/a>, which is advocating for more women on the bench, and opposed by conservative-leaning groups such as the <a href=\"http:\/\/www.nra.org\" target=\"_blank\">National Rifle Association<\/a>, which cited <strong>her representation of New York State in litigation against gun manufacturers<\/strong> &#8230; The <a href=\"http:\/\/www.rnla.org\" target=\"_blank\">Republican National Lawyers Association<\/a> has also come out against her nomination, claiming that she made inconsistent statements about her judicial philosophy. \u00a0In Senate testimony, the association says, Halligan wasn&#8217;t candid about her views on the <a href=\"http:\/\/www.usconstitution.net\" target=\"_blank\">Constitution<\/a> as a &#8220;living document.&#8221;
