{"id":28842,"date":"2024-09-29T10:11:46","date_gmt":"2024-09-29T14:11:46","guid":{"rendered":"http:\/\/www.gunpoliticsny.com\/?p=28842"},"modified":"2024-09-29T10:14:20","modified_gmt":"2024-09-29T14:14:20","slug":"local-elections-matter","status":"publish","type":"post","link":"http:\/\/www.gunpoliticsny.com\/?p=28842","title":{"rendered":"No Constitutional violation"},"content":{"rendered":"<p>I&#8217;ve lost count of how many times I&#8217;ve said 2A advocates need to be involved with elections at all levels.<\/p>\n<p>Here&#8217;s the <a href=\"https:\/\/www.wxxinews.org\/local-news\/2024-09-26\/monroe-county-response-in-federal-lawsuit-claims-second-amendment-doesnt-apply-to-private-citizens\" target=\"_blank\" rel=\"noopener\">latest reason<\/a>:<\/p>\n<blockquote><p><em>&#8220;New York\u2019s ban on body armor does not violate an individual\u2019s constitutional right to bear arms because no such right exists, according to the attorney representing <a href=\"https:\/\/en.wikipedia.org\/wiki\/Sandra_Doorley\" target=\"_blank\" rel=\"noopener\">Monroe County DA Sandra Doorley<\/a>. The unusual legal argument by <a href=\"https:\/\/opengovny.com\/attorney\/4984597\" target=\"_blank\" rel=\"noopener\">Deputy County Attorney Robert Shoemaker<\/a> was part of Doorley\u2019s answer to <a href=\"https:\/\/www.wivb.com\/news\/new-york\/federal-lawsuit-filed-in-wny-claims-nys-body-armor-ban-is-unconstitutional\/\" rel=\"noopener\" target=\"_blank\">a federal lawsuit challenging the legality of New York\u2019s ban on the public sale and purchase of body armor<\/a>. <strong>\u201cThere was and will be no Constitutional violation in enforcing the statute because the phrase \u2018bear arms\u2019 is a 1791-era idiom referring to military or militia service,\u201d Shoemaker wrote. \u201cPlaintiffs have failed to plead their involvement in a militia.\u201d<\/strong> &#8230;&#8221;<\/em><\/p><\/blockquote>\n<p>Outrageous.<\/p>\n<blockquote><p><em>&#8220;&#8230; Doorley, through a spokesperson, declined comment on Shoemaker\u2019s argument and referred questions to the county law department. A county spokesperson did not immediately respond to messages &#8230;&#8221;<\/em><\/p><\/blockquote>\n<p>There&#8217;s nothing they can say.<\/p>\n<blockquote><p><em>&#8220;&#8230; Shoemaker is an enrolled Democrat &#8230;&#8221;<\/em><\/p><\/blockquote>\n<p>I&#8217;m shocked.<\/p>\n<blockquote><p><em>&#8220;&#8230; Doorley has been a Republican since 2015 \u00ad she had been enrolled as a Democrat but switched parties during her bid for a second term in office. Their respective positions on gun rights was not immediately known &#8230;&#8221;<\/em><\/p><\/blockquote>\n<p>We know what their position is.<\/p>\n<blockquote><p><em>&#8220;&#8230; Doorley has previously supported pro-<a href=\"https:\/\/constitution.congress.gov\/constitution\/amendment-2\/\" rel=\"noopener\" target=\"_blank\">Second Amendment<\/a> candidates for office, including the <a href=\"https:\/\/www.npr.org\/2022\/11\/09\/1134203429\/new-york-governor-election-results-kathy-hochul-lee-zeldin\" rel=\"noopener\" target=\"_blank\">2022 gubernatorial contender Lee Zeldin<\/a>, a Republican who has an A-rating for gun rights support from the <a href=\"http:\/\/www.nra.org\" rel=\"noopener\" target=\"_blank\">National Rifle Association<\/a>.
