{"id":24573,"date":"2021-11-26T09:47:00","date_gmt":"2021-11-26T14:47:00","guid":{"rendered":"http:\/\/www.gunpoliticsny.com\/?p=24573"},"modified":"2021-11-26T09:47:00","modified_gmt":"2021-11-26T14:47:00","slug":"mandatory-storage-law-rarely-enforced","status":"publish","type":"post","link":"http:\/\/www.gunpoliticsny.com\/?p=24573","title":{"rendered":"Mandatory storage law rarely enforced"},"content":{"rendered":"<p>The Buffalo News reports that<a href=\"https:\/\/buffalonews.com\/news\/local\/crime-and-courts\/gun-at-frontier-middle-a-reminder-of-2019-law-requiring-safe-storage-around-kids-advocates\/article_2bf34350-4d30-11ec-b7d7-2f539e61ab33.html\" target=\"_blank\" rel=\"noopener\"> New York&#8217;s mandatory firearms storage law is rarely enforced<\/a>:<\/p>\n<blockquote><p><em>&#8220;A September incident in which a 12-year-old boy allegedly brought a loaded pistol, a loaded magazine and loose rounds to <a href=\"https:\/\/www.frontiercsd.org\/\" target=\"_blank\" rel=\"noopener\">Frontier Middle School<\/a> led to charges against the woman who owned the gun. Two weeks after the school incident, a Hamburg woman was charged with failing to safely store the gun. She is among the first in the state to be charged as the result of <a href=\"https:\/\/www.nysenate.gov\/legislation\/bills\/2019\/A2686\" target=\"_blank\" rel=\"noopener\">legislation passed in 2019<\/a> aimed at keeping guns away from children &#8230; The law requires owners of handguns, rifles and shotguns to safely store such weapons, either by keeping the weapons locked up or using a locking device on the firearm if there is a child under 16 who lives in the house or if there is a reasonable chance a child may visit the house. Before the law was passed in 2019, New York only required safe storage of weapons if there was a convicted felon or other person prohibited from owning a weapon in the residence. That was included in the <a href=\"https:\/\/safeact.ny.gov\/\" target=\"_blank\" rel=\"noopener\">New York SAFE ACT<\/a>, which passed in 2013 &#8230; <strong>The law is rarely used by prosecutors, according to records provided by the <a href=\"https:\/\/www.erie.gov\/da\/\" target=\"_blank\" rel=\"noopener\">Erie County District Attorney&#8217;s Office<\/a>. It was applied four times under the older provisions regarding people prohibited from owning guns and for the first time since it was amended in the Hamburg case.<\/strong> &#8230;&#8221;<\/em><\/p><\/blockquote>\n<p>The law should be abolished as it directly conflicts with <a href=\"https:\/\/www.law.cornell.edu\/supct\/html\/07-290.ZS.html\" target=\"_blank\" rel=\"noopener\"><em>Heller v. District of Columbia<\/em><\/a>.
