{"id":22838,"date":"2020-11-05T18:36:17","date_gmt":"2020-11-05T23:36:17","guid":{"rendered":"http:\/\/www.gunpoliticsny.com\/?p=22838"},"modified":"2020-11-05T18:52:49","modified_gmt":"2020-11-05T23:52:49","slug":"new-lawsuit-filed-challenging-the-sullivan-act","status":"publish","type":"post","link":"http:\/\/www.gunpoliticsny.com\/?p=22838","title":{"rendered":"New lawsuit filed challenging the Sullivan Act"},"content":{"rendered":"<p>The <a href=\"http:\/\/www.saf.org\" target=\"_blank\" rel=\"noopener noreferrer\">Second Amendment Foundation<\/a> and <a href=\"https:\/\/www.firearmspolicy.org\/\" target=\"_blank\" rel=\"noopener noreferrer\">Firearms Policy Coalition<\/a> have filed the first <a href=\"https:\/\/www.npr.org\/2020\/10\/26\/927640619\/senate-confirms-amy-coney-barrett-to-the-supreme-court\" target=\"_blank\" rel=\"noopener noreferrer\">post-ACB confirmation<\/a> lawsuit challenging the <a href=\"https:\/\/cityroom.blogs.nytimes.com\/2011\/01\/23\/100-years-ago-the-shot-that-spurred-new-yorks-gun-control-law\/\" target=\"_blank\" rel=\"noopener noreferrer\">Sullivan Act<\/a>.<\/p>\n<p>According to the <a href=\"https:\/\/www.saf.org\/saf-fpc-challenging-restrictive-n-y-city-carry-law-in-federal-lawsuit\/\" target=\"_blank\" rel=\"noopener noreferrer\">press release<\/a>:<\/p>\n<blockquote><p><em>&#8220;&#8230; The lawsuit challenges the inability of ordinary law-abiding citizens to obtain licenses to carry handguns in New York City. While honest citizens have a fundamental right to bear arms for self-protection, the complaint explains, the <a href=\"https:\/\/www1.nyc.gov\/site\/nypd\/index.page\" target=\"_blank\" rel=\"noopener noreferrer\">New York Police Department<\/a> requires applicants to provide a \u201cproper cause,\u201d which amounts to demonstrating a special or heightened need. As arbitrarily enforced, this requirement prevents average citizens from obtaining a carry permit, which violates their fundamental right to bear arms outside the home &#8230; \u201cLike the lawsuit against New Jersey\u2019s carry ban we filed earlier this week, we are suing New York City over their unconstitutional ban that prevents typical, law-abiding people from carry loaded, operable handguns on their person in public places,\u201d explained attorney <a href=\"https:\/\/twitter.com\/theadamkraut\" target=\"_blank\" rel=\"noopener noreferrer\">Adam Kraut<\/a>, FPC\u2019s Director of Legal Strategy &#8230;&#8221;<\/em><\/p><\/blockquote>\n<p>The case is titled <em><a href=\"https:\/\/www.saf.org\/wp-content\/uploads\/2020\/11\/127127918216.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Greco v. City of New York<\/a><\/em>.<\/p>\n<p>According to an associate of mine the case is assigned to <a href=\"https:\/\/www.nysd.uscourts.gov\/hon-lewis-j-liman\" target=\"_blank\" rel=\"noopener noreferrer\">Judge Lewis Liman<\/a>, who builds on family traditions. His father was <a href=\"https:\/\/en.wikipedia.org\/wiki\/Arthur_L._Liman\" target=\"_blank\" rel=\"noopener noreferrer\">Arthur Liman<\/a>, the chief counsel to the Democrat-led <a href=\"http:\/\/www.senate.gov\" target=\"_blank\" rel=\"noopener noreferrer\">Senate<\/a> during the <a href=\"https:\/\/www.history.com\/this-day-in-history\/congress-issues-final-report-on-iran-contra-scandal\" target=\"_blank\" rel=\"noopener noreferrer\">Iran-Contra investigations and hearings<\/a>.
