The Second Amendment Foundation<\/a> and Firearms Policy Coalition<\/a> have filed the first post-ACB confirmation<\/a> lawsuit challenging the Sullivan Act<\/a>.<\/p>\n

According to the press release<\/a>:<\/p>\n

“… The lawsuit challenges the inability of ordinary law-abiding citizens to obtain licenses to carry handguns in New York City. While honest citizens have a fundamental right to bear arms for self-protection, the complaint explains, the New York Police Department<\/a> requires applicants to provide a \u201cproper cause,\u201d which amounts to demonstrating a special or heightened need. As arbitrarily enforced, this requirement prevents average citizens from obtaining a carry permit, which violates their fundamental right to bear arms outside the home … \u201cLike the lawsuit against New Jersey\u2019s carry ban we filed earlier this week, we are suing New York City over their unconstitutional ban that prevents typical, law-abiding people from carry loaded, operable handguns on their person in public places,\u201d explained attorney Adam Kraut<\/a>, FPC\u2019s Director of Legal Strategy …”<\/em><\/p><\/blockquote>\n

The case is titled Greco v. City of New York<\/a><\/em>.<\/p>\n

According to an associate of mine the case is assigned to Judge Lewis Liman<\/a>, who builds on family traditions. His father was Arthur Liman<\/a>, the chief counsel to the Democrat-led Senate<\/a> during the Iran-Contra investigations and hearings<\/a>. Notwithstanding being a Trump<\/a> appointee, his pedigree and political history including donations are all solidly Democrat.\u00a0 We should assume plaintiffs are trying to build their case for the Supreme Court<\/a> since they should expect to make nothing but bad law at best until then.<\/p>\n
