{"id":21503,"date":"2020-04-03T10:01:39","date_gmt":"2020-04-03T14:01:39","guid":{"rendered":"http:\/\/www.gunpoliticsny.com\/?p=21503"},"modified":"2020-04-04T12:29:35","modified_gmt":"2020-04-04T16:29:35","slug":"budget-agreement","status":"publish","type":"post","link":"http:\/\/www.gunpoliticsny.com\/?p=21503","title":{"rendered":"Budget agreement"},"content":{"rendered":"<p>The <a href=\"https:\/\/twitter.com\/NYGovCuomo\" target=\"_blank\" rel=\"noopener noreferrer\">Governor<\/a> and legislature <a href=\"https:\/\/www.governor.ny.gov\/news\/governor-cuomo-announces-highlights-fy-2021-budget\" target=\"_blank\" rel=\"noopener noreferrer\">agreed to some gun control<\/a> as part of state budget negotiations:<\/p>\n<blockquote><p><em><strong>Closing the Out-of-State Gun Loophole:<\/strong>\u00a0The FY 2021 Enacted Budget includes legislation to prohibit individuals from obtaining a gun license who commit serious offenses out-of-state that would disqualify them from obtaining a gun license if committed in New York. This will provide greater consistency in New York&#8217;s licensing scheme and ensure individuals who are prohibited from purchasing a firearm are not able to do so. The Enacted Budget also includes legislation to require all state and local law enforcement agencies in the state to opt in to the ATF&#8217;s crime gun trace data sharing program and submit crime guns recovered through the <a href=\"https:\/\/etrace.atf.gov\/etrace\/\" target=\"_blank\" rel=\"noopener noreferrer\">ATF&#8217;s eTrace<\/a> system. Additionally, the Enacted Budget includes legislation to amend the Mental Hygiene Law to allow New York to share reports of individuals who are a danger to themselves or others with other states.<\/em><\/p><\/blockquote>\n<blockquote><p><em><strong>Removing Guns from Domestic Abusers:\u00a0<\/strong>The FY 2021 Enacted Budget authorize law enforcement to remove guns from the scene of a domestic violence incident.\u00a0 It would also establish a domestic violence misdemeanor to ensure abusers lose access to firearms immediately upon conviction. Further, it would authorize law enforcement officers to seize weapons from the home of an individual who becomes subject to a protective order arising out of a domestic dispute.<\/em><\/p><\/blockquote>\n<p>This crap is buried in <strong><a href=\"https:\/\/www.nysenate.gov\/legislation\/bills\/2019\/a9505\" target=\"_blank\" rel=\"noopener noreferrer\">A-9505B<\/a><\/strong>\/<strong><a href=\"https:\/\/www.nysenate.gov\/legislation\/bills\/2019\/s7505\" target=\"_blank\" rel=\"noopener noreferrer\">S-7505B<\/a><\/strong>.<\/p>\n<p>The Daily News has <a href=\"https:\/\/www.nydailynews.com\/news\/politics\/ny-cops-remove-firearms-report-of-domestic-violence-20200401-zbfwl6zq4fda3ilywgal4ymu6i-story.html\" target=\"_blank\" rel=\"noopener noreferrer\">remarks from the sponsor<\/a>:<\/p>\n<blockquote><p><em>\u201cDomestic violence incidents are emotionally charged and highly volatile,\u201d said <a href=\"https:\/\/nyassembly.gov\/mem\/Nily-Rozic\" target=\"_blank\" rel=\"noopener noreferrer\">Assemblymember Nily Rozic (D-Queens)<\/a> &#8230;\u201cHaving a gun in the household amplifies the risk of a domestic violence incident turning deadly.\u201d<\/em><\/p><\/blockquote>\n<p>I do not believe this is all the gun control the legislature will take up this year.
