{"id":14430,"date":"2017-04-22T11:24:19","date_gmt":"2017-04-22T15:24:19","guid":{"rendered":"http:\/\/www.gunpoliticsny.com\/?p=14430"},"modified":"2017-04-22T11:24:19","modified_gmt":"2017-04-22T15:24:19","slug":"another-scotus-retirement-coming","status":"publish","type":"post","link":"http:\/\/www.gunpoliticsny.com\/?p=14430","title":{"rendered":"Another SCOTUS retirement coming?"},"content":{"rendered":"<p>Some <a href=\"http:\/\/muscatinejournal.com\/muscatine\/news\/local\/grassley-says-he-expects-supreme-court-justice-resignation-within-the\/article_cf855340-8249-55d0-af7c-5cfea18f44cb.html\" target=\"_blank\" rel=\"noopener noreferrer\">more rumormongering<\/a> about another <a href=\"http:\/\/www.supremecourt.gov\" target=\"_blank\" rel=\"noopener noreferrer\">SCOTUS<\/a> justice retiring:<\/p>\n<blockquote><p><em>&#8220;During a visit to Muscatine Tuesday morning, <a href=\"http:\/\/www.grassley.senate.gov\" target=\"_blank\" rel=\"noopener noreferrer\">U.S. Sen. Chuck Grassley, R-Iowa<\/a>, the chairman of the <a href=\"http:\/\/www.judiciary.senate.gov\" target=\"_blank\" rel=\"noopener noreferrer\">Senate Judiciary Committee<\/a>, said he expects a Supreme Court Justice resignation within the year. &#8220;I would expect a resignation this summer,&#8221; he said &#8230;&#8221;<\/em><\/p><\/blockquote>\n<p><a href=\"http:\/\/www.cruz.senate.gov\" target=\"_blank\" rel=\"noopener noreferrer\">Ted Cruz<\/a> <a href=\"http:\/\/www.foxnews.com\/politics\/2017\/02\/23\/ted-cruz-odds-are-very-good-supreme-court-vacancy-this-summer.html\" target=\"_blank\" rel=\"noopener noreferrer\">said the same thing<\/a> back in February:<\/p>\n<blockquote><p><em>&#8220;Texas Sen. Ted Cruz told &#8220;<a href=\"http:\/\/www.foxnews.com\/on-air\/special-report-bret-baier\" target=\"_blank\" rel=\"noopener noreferrer\">Special Report with Bret Baier<\/a>&#8221; Thursday that &#8220;I think the odds are very good&#8221; that a second seat on the Supreme Court will fall vacant this year. &#8220;If not this summer, next summer,&#8221; Cruz told Bret Baier. &#8220;You know, judges don\u2019t like it when people kind of nudge them out, so they\u2019ll go when they decide to go.&#8221; &#8230;&#8221;<\/em><\/p><\/blockquote>\n<p>Please, please, please let it be <a href=\"https:\/\/en.wikipedia.org\/wiki\/Ruth_Bader_Ginsburg\" target=\"_blank\" rel=\"noopener noreferrer\">Ginsberg<\/a> who goes.\u00a0 She&#8217;s 84 and looks like half-past death now.<\/p>\n<p>Here is an old list of <a href=\"http:\/\/www.politico.com\/story\/2017\/01\/trumps-supreme-court-nominees-233115\" target=\"_blank\" rel=\"noopener noreferrer\">possible Trump appointments<\/a> the President could pick from if there is an vacancy on the court.\u00a0 <a href=\"https:\/\/en.wikipedia.org\/wiki\/Thomas_Hardiman\" target=\"_blank\" rel=\"noopener noreferrer\">Thomas Hardiman<\/a> from the <a href=\"http:\/\/www.ca3.uscourts.gov\" target=\"_blank\" rel=\"noopener noreferrer\">3rd District<\/a> has <a href=\"http:\/\/www.mcall.com\/news\/nationworld\/pennsylvania\/mc-hardiman-supreme-court-nominee-five-things-20170131-story.html\" target=\"_blank\" rel=\"noopener noreferrer\">a great record<\/a> on gun rights:<\/p>\n<blockquote><p><em>&#8220;&#8230; Hardiman established an expansive view of the right to own and carry firearms under the <a href=\"https:\/\/www.law.cornell.edu\/wex\/second_amendment\" target=\"_blank\" rel=\"noopener noreferrer\">Second Amendment<\/a> in his opinion disagreeing with a New Jersey law that required people applying for concealed weapons permits to show a &#8220;justifiable need&#8221; to be armed in public. Although Hardiman was alone among three judges in his opposition to the law, he wrote that it was unconstitutional because the need for self defense exists both inside and outside the home. Hardiman also authored an opinion in support of restoring the rights to possess weapons of two men convicted of non-violent misdemeanors. He was in the majority, finding that the Second Amendment barred gun ownership only for people convicted of violent crimes. But Hardiman went further than his colleagues in the majority, writing a concurring opinion that even violent felons could regain Second Amendment rights if their crimes were far in the past and the ex-offender had lived a law-abiding life since his arrest &#8230;&#8221;<\/em><\/p><\/blockquote>\n<p>The carry case was <a href=\"http:\/\/www.scotusblog.com\/case-files\/cases\/drake-v-jerejian\/\" target=\"_blank\" rel=\"noopener noreferrer\"><i>Drake v. Jerejian<\/i><\/a> which <a href=\"https:\/\/www.washingtonpost.com\/politics\/supreme-court-declines-to-review-new-jerseys-handgun-permit-law\/2014\/05\/05\/25f0fcd6-d457-11e3-95d3-3bcd77cd4e11_story.html\" target=\"_blank\" rel=\"noopener noreferrer\">SCOTUS declined to hear<\/a>. The other one was <a href=\"http:\/\/www2.ca3.uscourts.gov\/opinarch\/144549p.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><em>Binderup v.
