{"id":14359,"date":"2017-04-09T12:51:41","date_gmt":"2017-04-09T16:51:41","guid":{"rendered":"http:\/\/www.gunpoliticsny.com\/?p=14359"},"modified":"2017-04-09T12:51:41","modified_gmt":"2017-04-09T16:51:41","slug":"gorsuch-to-decide-whether-to-take-gun-cases","status":"publish","type":"post","link":"http:\/\/www.gunpoliticsny.com\/?p=14359","title":{"rendered":"Gorsuch to decide whether to take gun cases"},"content":{"rendered":"<p>We&#8217;re going to <a href=\"https:\/\/www.washingtonpost.com\/politics\/courts_law\/immediate-impact-gorsuch-could-redefine-supreme-court-starting-next-week\/2017\/04\/07\/24e6a9cc-1ae9-11e7-9887-1a5314b56a08_story.html\" target=\"_blank\">find out soon<\/a> if <a href=\"http:\/\/www.biography.com\/people\/neil-gorsuch-020617\" target=\"_blank\">Justice Neil Gorsuch<\/a> is pro-gun or not as <a href=\"http:\/\/www.supremecourt.gov\" target=\"_blank\">SCOTUS<\/a> has two petitions pending on gun cases:<\/p>\n<blockquote><p><em>&#8220;&#8230; The most important is a petition from gun rights activists asking the court to find for the first time that the <a href=\"https:\/\/www.law.cornell.edu\/wex\/second_amendment\" target=\"_blank\">Second Amendment<\/a> right to keep a gun for self-defense extends to carrying firearms outside the home. In cases from California, the full <a href=\"http:\/\/www.ca9.uscourts.gov\" target=\"_blank\">U.S. Court of Appeals for the 9th Circuit<\/a> ruled that it did not. \u201cAny prohibition or restriction a state may choose to impose on concealed carry \u2014 including a requirement of \u2018good cause,\u2019 however defined \u2014 is necessarily allowed by the [Second] Amendment,\u201d it said. A strongly worded dissent said \u201cany fair reading\u201d of the <a href=\"https:\/\/www.law.cornell.edu\/supct\/html\/07-290.ZS.html\" target=\"_blank\">Supreme Court\u2019s 2008 decision<\/a> finding a constitutional right to gun ownership for self-defense \u201ccompels the conclusion that the right to keep and bear arms extends beyond one\u2019s front door.\u201d A second case involves whether those convicted of certain crimes can be barred indefinitely from possessing firearms &#8230;&#8221;<\/em><\/p><\/blockquote>\n<p>The California case is <em><a href=\"http:\/\/michellawyers.com\/guncasetracker\/perutavsandiego\/\" target=\"_blank\">Peruta v. California<\/a><\/em> which is <a href=\"https:\/\/www.nraila.org\/articles\/20170113\/supreme-court-asked-to-review-california-s-restrictive-carry-regime\" target=\"_blank\">backed by the NRA &amp; CRPA<\/a>.\u00a0 This is the one that could ultimately make New York <em>shall-issue<\/em>.<\/p>\n<p>I believe the second case is <em><a href=\"http:\/\/caselaw.findlaw.com\/us-10th-circuit\/1592134.html\" target=\"_blank\">United States v.
