{"id":11902,"date":"2015-09-30T13:51:46","date_gmt":"2015-09-30T17:51:46","guid":{"rendered":"http:\/\/www.gunpoliticsny.com\/?p=11902"},"modified":"2015-09-30T13:51:46","modified_gmt":"2015-09-30T17:51:46","slug":"probably-wont-work","status":"publish","type":"post","link":"http:\/\/www.gunpoliticsny.com\/?p=11902","title":{"rendered":"Probably won&#8217;t work"},"content":{"rendered":"<p><a href=\"http:\/\/www.newsday.com\/long-island\/nassau\/3-ex-nassau-correction-officers-and-a-former-deputy-sheriff-sue-over-gun-permit-denial-1.10904942\" target=\"_blank\">Newsday reports<\/a>:<\/p>\n<blockquote><p><em>&#8220;Three retired Nassau County correction officers and a retired deputy sheriff claim in a civil suit they&#8217;ve been unjustly denied special police-retiree gun permits and licenses by county authorities.\u00a0 The suit, filed Monday in federal court in Central Islip, claims <a href=\"http:\/\/www.nassaucountyny.gov\/1891\/Sheriffs-Department\" target=\"_blank\">Nassau Sheriff Michael Sposato<\/a> and the <a href=\"http:\/\/www.police.co.nassau.ny.us\" target=\"_blank\">Nassau County Police Department<\/a> have denied licenses to the four because of disabilities &#8230;&#8221;<\/em><\/p><\/blockquote>\n<p>This probably won&#8217;t work given that the <a href=\"http:\/\/www.ca2.uscourts.gov\" target=\"_blank\">2nd Circuit<\/a> ruled in the <em><a href=\"http:\/\/caselaw.findlaw.com\/us-2nd-circuit\/1615960.html\" target=\"_blank\">Kachalsky v. Cacace<\/a><\/em> case that licensing agents are not obligated to issue pistol licenses to anyone.<\/p>\n<blockquote><p><em>&#8220;&#8230; &#8220;This suit is necessary to change how disabled officers, who served this county well, are being treated by the county when they want the same benefits that other retirees get,&#8221; said Frederick Brewington, the Hempstead attorney representing [the plaintiffs]. &#8220;None of their disabilities make them ineligible to own, purchase and carry firearms, and there is no good reason for them to have been treated differently.&#8221; &#8230;&#8221;<\/em><\/p><\/blockquote>\n<p>That&#8217;s the thing.
