“Ghost gun” bill to come up

The Daily News reports that legislation prohibiting so-called “ghost guns” will be taken up by the Senate on Wednesday.

The bill in question is S-1414A which was amended last week and is on 3rd Reading.

The Assembly companion is A-763A and it has been on the calendar since the end of January.

So-called “Second Amendment Sanctuaries” have been increasing in popularity around the country

Gun Owners of America began distributing this template for New York municipalities.  Essentially, they want municipalities to enact legislation prohibiting the use of monies to enforce the SAFE Act and other gun control laws.

I don’t see any problems asking locals not to spend money on gun control enforcement, however, SAFE itself is funded through the state budget and Albany legislators cannot defund it this way.  I am not aware of any New York municipality which has enacted something like this so I am unsure how effective this tactic is even from a public relations standpoint.  Generally, the best way to defeat gun control for gun owners to be involved in the selection and election processes for candidates at all levels of government.

Possible good news from the 2nd Circuit

Bloomberg Law reports:

“President Donald Trump is in striking range of flipping another federal appeals court to a majority of Republican-appointed judges, this one based in his home state of New York. The Senate on Wednesday confirmed Joseph Bianco to the U.S. Court of Appeals for the Second Circuit, in a 54 to 42 vote that included some Democratic support. A second appointment to that court, Consovoy McCarthy Park partner Michael Park, is expected to be confirmed this week after the chamber voted to end debate on his nomination … Although a majority of appointments by a president of one party or another doesn’t guarantee case outcomes, Trump has vowed to appoint conservative judges in the mold of the late Supreme Court Justice Antonin Scalia, a proponent of originalism and textualism … The president doesn’t have to wait until the next two soon-to-be-open Second Circuit seats are empty to nominate replacements, and it’s not clear who he’s thinking about to fill those spots. The court handles cases in New York, Connecticut and Vermont …”

This could have positive ramifications for 2A rights if/when some future New York gun law is challenged.

NYC City Council on “ghost” guns

A typical tactic of the Left is to make up some phony issue, in this case “ghost” guns, get some of their elected supporters at the local level to pass legislation and/or memorializing resolutions which addresses the “problem”, and use this a mechanism to push for state and/or federal action on similar bills.

With astroturf advocating in Albany this week for even more gun control, I knew the Clown Council was going to chime in on this.

They did not disappoint:

“It will be a crime to own parts that can be used to forge homemade untraceable guns, under new legislation two City Council members are introducing Wednesday, the Daily News has learned. The bootleg weapons — which do not have serial numbers — making them impossible to trace, are commonly referred to as “ghost guns” … City Councilwoman Helen Rosenthal (D-Manhattan) said it is “unnerving” that anyone with an internet connection and enough technical expertise can make a customized gun at home … Daneek Miller (D-Queens), who co-sponsored the bills with Rosenthal, said the NYPD has told him police have recovered some ghost guns but did not have a specific number … Miller thinks the bill is a chance to make a statement that might lead to federal legislation down the line. “New York City should be a leader, getting ahead of this,” Rosenthal said …”

Bill numbers are RES 866-2019 and INT 1548-2019.

The Resolution calls upon Congress to enact H.R.7115 from the 2017-18 session. The Introduction amends local law.

“Undetectable” firearms bill amended

Fresh off yesterday’s remarks by Sen. Gianaris that their work is not done, comes this report by Nick Reisman:

“… now lawmakers want to go further, including the passage of stalled ban on 3-D printed guns and funding for gun violence research efforts … Lawmakers had previously considered a bill that would ban guns manufactured by a 3-D printer. But the bill was pulled after some raised concerns over the language in the measure being overly broad …”

Sure enough the Senate version of the “undetectable” firearms bill S-1414A was just amended.

Basically, an “undetectable” firearm is one that, after removing the magazines and furniture, cannot be determined to be a gun by commonly used devices at airports for security.

I’m sure they will sync up the companion A-763 shortly.

Senator Gianaris “our work is not yet done”

Deputy Majority Leader Senator Mike Gianaris spoke with astroturf who were advocating in Albany for even more gun control.

Note his comment at 0:42 about wishing he could more outside New York.
